Please read these Terms of Service carefully before accessing or using our website or placing an order. By accessing or using any part of the site, you agree to be bound by these Terms.

These Terms should be read together with our Privacy Policy, Delivery Policy and Returns & Refunds Policy.

Nothing in these Terms affects your statutory rights as a consumer.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to sell our products and services to you. Any contract for goods purchased from this website is between you and Kitchen Wonderland Limited.


2. USING OUR WEBSITE

You may use our website only for lawful purposes.

If you create an account, you are responsible for keeping your account information and password secure and for ensuring that the information you provide to us is accurate and up to date.

You must not misuse the website, introduce viruses or other malicious code, attempt to gain unauthorised access to the website or its systems, or interfere with the proper operation or security of the website.


3. OUR PRODUCTS

We take reasonable care to ensure that product descriptions, specifications, images and prices displayed on our website are accurate.

Product images are for illustrative purposes. Colours and appearance may vary depending on your screen and, where relevant, natural materials, finishes and reasonable manufacturing tolerances.

We may update product information or discontinue products from time to time. Changes will not affect an order that we have already accepted unless we agree the change with you or it is necessary to correct an obvious error and the law permits us to do so.

Where a product is supplied with a manufacturer or commercial warranty, the applicable warranty terms will be stated separately. Any commercial warranty is provided in addition to, and does not replace, your statutory consumer rights.


4. ORDERS AND ACCEPTANCE

When you place an order through our website, you are making an offer to purchase the products in your basket.

An automated order acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and Kitchen Wonderland Limited is formed when we confirm that we have accepted your order or, if earlier, when we dispatch the goods.

We may decline or cancel an order before acceptance if, for example:

  • a product is unavailable;
  • there is an obvious pricing or product-description error;
  • payment cannot be authorised;
  • we are unable to deliver to your address; or
  • we reasonably suspect fraud, misuse or an unauthorised transaction.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled goods.


5. PRICES AND PAYMENT

Prices displayed to UK consumers include VAT where applicable unless clearly stated otherwise.

Delivery charges and any other unavoidable charges will be shown before you place your order.

The price payable will normally be the price shown when you place your order, subject to the correction of obvious errors.

We will not charge you a higher price without informing you and giving you the opportunity to cancel before the order is accepted.

Payment must be made using one of the payment methods offered at checkout. By submitting payment details, you confirm that you are authorised to use the selected payment method.


6. DELIVERY

We will deliver your order to the delivery address supplied when you place your order.

Any delivery date or timescale provided is an estimate unless we have expressly agreed that delivery by a particular date is essential.

We remain responsible for the goods until they come into your physical possession or the physical possession of a person you have nominated to receive them.

If you independently arrange for a carrier that we did not offer as a delivery option, responsibility for the goods may pass when we hand them to that carrier.

If delivery is delayed because of circumstances outside our reasonable control, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect of the delay.

Your statutory rights in relation to late or failed delivery are not affected.


7. YOUR RIGHT TO CANCEL AN ONLINE ORDER

If you are a consumer purchasing online, you will normally have a legal right to change your mind and cancel your contract within 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.

If your order contains multiple goods delivered on different days, the cancellation period will normally run from the day after the last of those goods is received.

To exercise your right to cancel, you must clearly tell us that you wish to cancel your order.

You can contact us using the details provided in these Terms or follow the cancellation process described in our Returns & Refunds Policy.

You do not have to provide a reason for cancelling.

Certain goods are excluded from the statutory right to cancel, including some goods made to your specification or clearly personalised and other categories excluded by law. Where an exclusion applies, we will make this clear where appropriate.


8. RETURNING GOODS AFTER CANCELLATION

Unless we have offered to collect the goods, you must return cancelled goods without undue delay and normally within 14 days of telling us that you wish to cancel.

You must take reasonable care of the goods while they are in your possession.

You may inspect goods as you reasonably would in a shop. However, we may be entitled to reduce your refund to reflect any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Responsibility for return delivery costs will be explained in our Returns & Refunds Policy and in the information provided before purchase where required.

For goods that cannot normally be returned by post, any applicable return-cost information will be provided in accordance with applicable consumer law.


9. REFUNDS FOLLOWING CANCELLATION

Where you validly cancel an order under your statutory cancellation rights, we will refund payments due to you in accordance with applicable law.

Where required by law, this includes the standard outbound delivery charge. It does not include any additional amount you chose to pay for a more expensive delivery service.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

Where permitted by law, we may withhold a refund for returned goods until we have received the goods back or you provide evidence that you have sent them back, whichever occurs first.


10. FAULTY, DAMAGED OR MISDESCRIBED GOODS

We are under a legal duty to supply goods that conform to the contract.

Goods must, among other things, be as described, of satisfactory quality and fit for any particular purpose made known to us where the relevant legal requirements are met.

If goods are faulty, damaged, not as described or otherwise fail to conform to the contract, you may have statutory rights to remedies including repair, replacement, price reduction, rejection and/or refund depending upon the circumstances and timing.

These rights are separate from your 14-day cancellation rights and from any manufacturer or commercial warranty.

Promotions, bundles, discount codes and special offers may be subject to additional terms.

Where specific promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion, provided that they comply with applicable law.

Unless otherwise stated, promotional offers are subject to availability and may be withdrawn or amended before an order is accepted.

The website and its content, including text, graphics, photographs, video, branding, logos, product imagery and design elements, are owned by or licensed to Kitchen Wonderland Limited or the relevant rights holder and are protected by applicable intellectual property laws.

Shopify provides the ecommerce technology that enables us to operate our online store.

Products purchased through Kitchen Wonderland are sold by Kitchen Wonderland Limited, not Shopify.

Shopify and other service providers may also process information where necessary to provide ecommerce, payment, delivery and related services.

16. REVIEWS, FEEDBACK AND USER CONTENT

If you submit a review, photograph, comment or other content to us, you confirm that you have the right to submit it and that it is not unlawful, misleading, defamatory, infringing or otherwise prohibited.

Where you grant us permission to use submitted content, we may use that content in connection with operating and promoting Kitchen Wonderland in accordance with the permission obtained and applicable law.

We may moderate or remove content where reasonably necessary.


17. ERRORS AND CORRECTIONS

This does not affect any rights you have under applicable law, including your rights relating to delivery.

If you live in Scotland, you may bring legal proceedings in Scotland or, where applicable, England and Wales.

If you live in Northern Ireland, you may bring legal proceedings in Northern Ireland or, where applicable, England and Wales.

Nothing in these Terms removes any mandatory legal protections available to you in the country in which you live.
